Privacy Policy for Unbound Within

IMPORTANT: Unbound Within is a trauma-informed creative ministry and pastoral accompaniment service. It is not a licensed medical, psychiatric or regulated psychotherapy practice. Services are provided as spiritual and pastoral support, creative facilitation and personal accompaniment — not as clinical treatment. Unbound Within is committed to protecting the privacy of your personal information. This Privacy Policy explains how we collect, use, and protect your information when you visit our website or engage our services.
Unbound Within is operated by Gabriela With, based in Germany. We serve clients worldwide. We comply with the General Data Protection Regulation (GDPR) as our primary framework. Where clients reside in Canada, we additionally adhere to PIPEDA. Where clients reside in the United Kingdom, we additionally adhere to the UK GDPR and the Data Protection Act 2018.
Article 1 — Information We Collect

Website visits: IP address, browser type, referring website, pages visited, and time spent. We may use cookies and other tracking technologies.

Contacting us: Your name, contact information, and any other information you choose to provide.

Booking and services: Information necessary for those services, including name, contact information and payment information.

Questionnaire responses: Information you provide through the client intake questionnaire is held in strict confidence.
Article 2 — How We Use Your Information

Services: Providing and improving our services, scheduling, communication, and processing of donations or suggested contributions.

Website: Operating and maintaining our website, personalising your experience, and analysing usage.

Communication: Responding to enquiries, session reminders, and service information.

Legal: Complying with applicable laws and regulations in Germany and internationally.
Article 3 — Disclosure of Your Information

Service providers: We may share information with providers (e.g. website hosting, payment processing) under contractual obligation to protect your information.

Legal authorities: We may disclose information if required by law or legal process.

With your consent: We may disclose information with your explicit written consent.

Safety: If we believe there is a risk of serious harm to you or another person, we may contact appropriate emergency services. We will inform you of this if at all possible.
Article 4 — Data Security
We take reasonable technical and organisational measures to protect your personal information. All session notes are stored securely and access is restricted to Gabriela With only. However, no online method is 100% secure, and we cannot guarantee absolute security.
Article 5 — Your Rights Under GDPR

Article 6 — Data Retention
We retain personal data only for as long as necessary to provide our services and comply with legal obligations. Session records are destroyed at the end of the therapeutic relationship. Financial records are retained for the period required under German tax law.
Article 7 — Children's Privacy
Our services are for adults (18+) only. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with information, please contact us immediately.
Article 8 — International Data Transfers
As we operate worldwide from a base in Germany, your data may be processed in countries outside the European Economic Area. Where this occurs, we ensure appropriate safeguards are in place in accordance with GDPR requirements.
Article 9 — Changes to this Policy
We may update this policy from time to time. Changes will be posted on our website with a revised effective date. Your continued use of our services constitutes acceptance of the updated policy.

Section II
Terms & Conditions for Unbound Within

These Terms and Conditions govern your engagement with Unbound Within's services. By booking a session or submitting an enquiry, you agree to be bound by these terms.
Article 1 — Nature of Services
Unbound Within provides trauma-informed creative accompaniment, pastoral support and creative facilitation. This includes but is not limited to: trauma-informed healing work, art therapy, writing therapy, Bibliodrama, Powerful Peace and body-based awareness.
These services are offered as spiritual and pastoral support and creative facilitation by a trained and certified practitioner. They are not a substitute for medical advice, psychiatric treatment, or regulated clinical psychotherapy. If you require acute psychiatric or medical intervention, Gabriela will support you in accessing appropriate professional services but cannot provide that care herself.
Article 2 — Booking and Cancellation

Enquiries are made through the website contact form or by direct message.

All bookings are confirmed in writing after an initial consultation.

Cancellations for individual online sessions require 48 hours' notice. Failure to provide adequate notice may result in a suggested contribution being requested for the missed session.

Cancellation terms for Healing Beyond Borders immersive journeys are outlined separately in the Client Contract and Payment Agreement.
Article 3 — Financial Arrangements
Unbound Within operates primarily as a ministry and on a donation/contribution basis. All financial arrangements are discussed openly and personally before any commitment is made.

Individual online sessions: offered on a donation basis. A suggested contribution range is discussed during the initial consultation.

Healing Beyond Borders (immersive journey): a suggested contribution is discussed personally, based on the client's country of residence and economic context. A sliding scale is used — from fully sponsored placements in war zones and developing nations, to suggested contributions for higher-income countries. No one is turned away for financial reasons alone.

Accepted methods: PayPal, bank transfer or in person.

In all cases, the exact arrangement is agreed in writing before any work begins.
Article 4 — Client Responsibilities

Providing accurate and honest information in the intake questionnaire and during sessions.

Attending agreed sessions on time or giving adequate notice of changes.

Actively engaging with the process — being open, honest and willing to participate.

Not consuming alcohol or non-prescribed substances on session days or in a way that impairs engagement.

Honouring the agreed financial contribution promptly.
Article 5 — Confidentiality
All information shared during sessions is held in strict confidence, subject to the limitations outlined in Section III (Confidentiality Agreement).
Article 6 — Boundaries and Mutual Respect
Both parties agree to treat each other with dignity, respect and kindness throughout the working relationship. Any form of verbal, emotional or physical aggression toward Gabriela With is grounds for immediate termination of the engagement.
Article 7 — Recording and Social Media

Sessions may not be recorded (audio or video) by the client without Gabriela's explicit written consent.

The client agrees not to post about sessions or tag Gabriela on social media without prior written permission.

By engaging services, the client permits Gabriela to share photographs of any jointly created art project on her website and social media for promotional purposes, provided no identifying personal information (full name, face, location) is included without additional explicit consent.
Article 8 — Co-Authorship and Creative Works
Where the working relationship results in the creation of a book, written work or creative publication, Gabriela With is to be recognised as co-author, reflecting her contribution to the creative and healing process. The terms of any publication arrangement will be discussed and agreed in writing between the parties at the time of publication.
Article 9 — Disclaimer and Limitation of Liability
To the extent permitted by applicable law, Unbound Within and Gabriela With shall not be held liable for any direct, indirect, incidental, special or consequential damages arising from the use of our services or website. Our services are provided as pastoral support and creative facilitation. They are not a substitute for medical or psychiatric care.
Unbound Within is not liable for any loss, damages or injury resulting from your use of our services, except in cases of gross negligence or wilful misconduct.
Article 10 — Governing Law and Dispute Resolution
These terms are governed by the laws of Germany, reflecting Gabriela With's German citizenship and place of business registration. Any disputes arising from this agreement that cannot be resolved between the parties will be referred to mediation before any legal proceedings are initiated.
Article 11 — Changes to These Terms
We may update these terms. Changes will be posted with a revised effective date. Your continued use of our services constitutes acceptance.

Section III
Confidentiality Agreement for Unbound Within
Effective Date: 02/03/2025 — revised May 2026
This Confidentiality Agreement outlines the confidential nature of the relationship between you (the "Client") and Unbound Within (the "Practitioner"). In this document, "Practitioner" refers to Gabriela With in her capacity as a trauma-informed creative specialist and pastoral accompaniment worker — not as a licensed therapist or regulated healthcare provider.
Article 1 — Confidentiality
All information shared within this working relationship — in sessions, conversations, written exchanges, art, and all personal disclosures — is held in complete confidentiality by Gabriela With. Gabriela will not share any information about the client's identity, story or progress with any third party without the client's explicit written consent, except as outlined in Article 2 below.
The client agrees to maintain the same confidentiality in respect of Gabriela's personal disclosures, methods and any information shared in the context of the working relationship.
Article 2 — Exceptions to Confidentiality

Legal requirements: If Gabriela is legally mandated to report risk of serious harm to a child, or credible risk of serious harm to the client or another person. In such cases, appropriate emergency or child protection services may be contacted. Gabriela will inform the client of this if at all possible.

Client's written consent: If the client provides explicit written permission to share specific information with a named third party.

Professional supervision: Gabriela may discuss cases with a professional supervisor for the purposes of professional development and ethical practice. In such cases, identifying information will be protected to the greatest extent possible.
Note on jurisdiction: Mandatory reporting obligations vary by country. Where Gabriela is working in a client's country under the Healing Beyond Borders programme, the reporting obligations of that country may apply. Gabriela will always act in accordance with the most protective legal framework available.
Article 3 — Client Rights

You have the right to access the records held about you.

You have the right to request corrections to your records.

You have the right to request that your records be destroyed at any time, subject to any legal obligations to retain them.
Article 4 — Practitioner Responsibilities
Gabriela With is committed to maintaining confidentiality and adhering to the ethical guidelines of her professional training and certifications. She will not use information shared by clients for any purpose other than the direct provision of the agreed services.
Article 5 — Record Keeping
Unbound Within maintains written records of sessions where appropriate. If you prefer that no written records be kept, please discuss this before sessions begin. All records are stored securely, accessible only to Gabriela With, and will be destroyed at the end of the working relationship or upon your request — whichever comes first.
For Healing Beyond Borders clients, any art works, written materials or creative outputs created during the journey are the property of the client unless otherwise agreed in writing.
Article 6 — Electronic Communication

Online sessions are conducted via doxy.me, which operates under applicable data protection regulations. Information shared through this platform is encrypted in transit.

Email communication is used for non-sensitive administrative matters such as scheduling. Sensitive personal information should not be shared by email.

Text messaging (SMS or WhatsApp) may be used only for brief, non-sensitive communication such as confirming appointments. Therapeutic content or sensitive personal information must not be shared by text message.

As with all electronic communication, no method is entirely risk-free. Gabriela takes reasonable precautions but cannot guarantee the security of any electronic channel.

Article 7 — Mutual Confidentiality
This agreement is mutual. Gabriela With also agrees to hold in confidence any personal information about herself that she shares in the context of the working relationship, and does not expect or require clients to share this information with others.
Article 8 — Changes to this Agreement
We may update this agreement. Changes will be posted with a revised effective date. Your continued engagement with our services constitutes acceptance.
